General Terms and Conditions

1. Geltungsbereich
Für alle Bestellungen über unseren Online-Shop gelten die nachfolgenden AGB.

2. Vertragspartner, Kundendienst

3. Vertragsabschluss
Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern einen unverbindlichen Online-Katalog dar. Durch Anklicken des Bestellbuttons geben Sie eine verbindliche Bestellung der im Warenkorb enthaltenen Waren ab. Die Bestätigung des Eingangs der Bestellung erfolgt zusammen mit der Annahme der Bestellung durch eine E-Mail. Mit dieser E-Mail-Bestätigung ist der Kaufvertrag zustande gekommen. Bedingung für einen wirksamen Vertragsschluss ist stets, dass der Bestellvorgang mit Absenden der Bestellung abgeschlossen wird.
Alle Vereinbarungen, mündlich oder telefonisch, werden erst mit der schriftlichen Auftragsbestätigung bindend. Die in Katalogen, Preislisten oder den zum Angebot gehörenden Unterlagen enthaltenen Maße, Angaben, Zeichnungen, Abbildungen und Leistungsbeschreibungen sind branchenübliche Näherungswerte, technische und/oder gestalterische Details können von den Abbildungen abweichen und verändert werden.

4. Versandkosten
Zuzüglich zu den angegebenen Produktpreisen kommen noch Versandkosten hinzu. Näheres zur Höhe der Versandkosten erfahren Sie bei den jeweiligen Angeboten oder ggfls. durch Nachfrage bei der Hinterher GmbH.

5. Bezahlung
Die Zahlung erfolgt per Vorkasse.
Bei Auswahl der Zahlungsart Vorkasse nennen wir Ihnen unsere Bankverbindung in der Auftragsbestätigung und liefern die Ware nach Zahlungseingang. Bitte bedenken Sie, dass Ihr Auftrag erst bearbeitet werden kann, wenn der Zahlungseingang für Ihre Bestellung auf unserem Konto bestätigt wurde.

6. Barzahlung bei Selbstabholung
Sie haben grundsätzlich die Möglichkeit der Abholung bei der Hinterher GmbH, Lohenstraße 11, 82166 Gräfelfing. Terminvereinbarung ausschliesslich nach Absprache, telefonisch unter 089-41554200 oder per Mail unter info@hinterher.com

7. Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum. Bei Beschlagnahme oder Pfändung der Ware vor Bezahlung (z.B. bei Nichteinlösung der Lastschrift) ist der Kunde verpflichtet, auf den Eigentumsvorbehalt hinzuweisen und muss uns unverzüglich benachrichtigen.

8. Transportschäden
Werden Waren mit offensichtlichen Transportschäden angeliefert, verweigern Sie die Annahme oder reklamieren Sie den Schaden sofort beim Zusteller (schriftlicher Hinweis auf der Spediteur-Übergabebescheinigung!) und nehmen Sie unverzüglich Kontakt mit uns auf!

9. Verpackung
Papier-, Karton- und Kunststoffverpackungen werden nicht zurückgenommen.

10. Mängelrügen
Der Käufer/Auftraggeber hat die Ware unverzüglich bei Empfang zu prüfen. Sowohl offene als auch verdeckte Mängel sind innerhalb von 5 Tagen ab Erhalt der Ware zu rügen. Erfolgt bis nach Ablauf dieser Frist keine Mängelrüge, so sind jegliche Mängelrechte verwirkt. Dasselbe gilt im Falle anderweitiger Verfügung über die Ware durch den Käufer/Auftraggeber.

11. Widerrufsbelehrung

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.
Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat. Das Widerrufsrecht gilt nicht für Produkte, die auf Kundenwunsch konfiguriert, montiert oder umgebaut werden.
Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Hinterher GmbH, Lohenstraße 11, 82166 Gräfelfing, Tel. 089-41554200, info@hinterher.com) mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief, Telefax oder E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das von uns bereitgestellte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Das Musterformular können Sie hier herunterladen:

To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation
If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You are legally obliged to inform us of the withdrawal from this contract within the specified period and to return or hand over the goods to our above address. The deadline is met if you send the goods before the expiry of the fourteen-day period. You bear the direct costs of returning the goods in an insured package or, in the case of corresponding shipments, by freight forwarder. Freight forwarding shipments can incur considerable costs; in most cases, the shipping costs we charge you provide information about the expected costs.
You will only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality.

12. Duty to provide information on the ODR Regulation
In accordance with the ODR Regulation, which came into force on January 9, 2016, and is mandatory throughout the EU, customers of online shops must be informed that the EU Commission provides an internet platform for the resolution of disputes in consumer law. 13. Delivery dates
Delivery times are not binding for the supplier. The supplier may exceed a specified delivery period by up to 6 weeks. The customer may only set a reasonable grace period after this period has expired. After this grace period has expired without result, the purchaser has the right to withdraw from the contract.
Any claims of any kind whatsoever by the buyer/client arising from delays in delivery are excluded.
The supplier is released from compliance with any delivery period and may withdraw from the contract at any time if the customer is in default of payment for previous orders or for a partial delivery of an order.

14. Other claims for compensation
Claims for damages arising from delay, impossibility of performance, culpable breach of ancillary contractual obligations, culpa in contrahendo, and tort are excluded, unless they are based on intent or gross negligence on the part of the supplier. Liability for grossly negligent breaches shall also be limited to compensation for the damage foreseeable at the time the contract was concluded.

15. Deviating agreements
Any agreements deviating from these General Terms and Conditions shall only be valid in writing.

We store the contract text and send you the order details and our General Terms and Conditions by email. You can also view and download the General Terms and Conditions at any time on this page.

17. Contract language
The language available for the conclusion of the contract is German.
